SDP Calls President Tinubu’s Declaration of Emergency Rule in Rivers Unconstitutional

The Social Democratic Party (SDP) has voiced its deep concern and surprise over the declaration of a state of emergency in Rivers State, as well as the suspension of the state’s democratically elected governor and legislature by President Bola Tinubu.

In a statement, the party’s National Publicity Secretary, Araba Rufus Aiyenigba, described the president’s decision as unconstitutional and poorly thought out, asserting that it does not serve the broader interest of Nigeria.

Aiyenigba called on the National Assembly to critically assess the situation and deny the necessary approval for such an action, which he emphasized is of significant national importance.

“After carefully considering the reasons provided by the president for this declaration, we have concluded that this decision is unconstitutional and fails to align with the best interests of the Nigerian state,” Aiyenigba said.

He further explained that the ongoing political crisis in Rivers State does not justify the declaration of a state of emergency. He pointed out that the situation does not meet the constitutional criteria for such an extreme measure, which would typically be reserved for situations where public order and safety have completely broken down and cannot be restored through ordinary legal means.

“The decision to declare a state of emergency in Rivers State is an overreaction and an assault on democracy, which directly conflicts with the spirit and intent of Section 305 of the Constitution of the Federal Republic of Nigeria, 1999, as amended,” Aiyenigba stated.

The SDP spokesperson urged the National Assembly to act in the nation’s true interest, scrutinizing the situation carefully and withholding approval for the presidential action.

“As a political party committed to the genuine welfare of Nigeria, the SDP stands firmly with the people of Rivers State during this challenging time,” Aiyenigba continued. “We urge them to remain calm, trusting that reason will prevail and democracy will soon be restored.”

He also reminded Nigerians of the importance of vigilance in preserving democracy, quoting Thomas Jefferson’s famous words: “The price of liberty is eternal vigilance.” The SDP spokesperson concluded by encouraging all citizens to remain committed to safeguarding democracy and strengthening public institutions for the benefit of all Nigerians.
